About Burglary Washington Sentencing
Washington State uses a determinate sentencing system based on a sentencing grid defined in RCW 9.94A.510. This calculator helps estimate sentencing ranges for burglary offenses by combining the Offense Seriousness Level with the defendant's Offender Score.
Washington recognizes three levels of burglary offenses:
- Burglary 1 (RCW 9A.52.020): Class A felony, Level VII. Entering a dwelling to commit a crime while armed with a deadly weapon or assaulting someone inside.
- Residential Burglary (RCW 9A.52.025): Class B felony, Level IV. Unlawfully entering or remaining in a dwelling with intent to commit a crime.
- Burglary 2 (RCW 9A.52.030): Class B felony, Level III. Unlawfully entering or remaining in a building (non-dwelling) with intent to commit a crime.
Unlike many violent offenses, burglary offenses are not classified as violent crimes under Washington law, even though they are serious felonies. However, weapon enhancements may still apply if a firearm or deadly weapon was used during the commission of the offense.

Important Notes
- β’Sentencing Grid Structure: Washington's sentencing grid uses Offense Seriousness Levels (IβXVI) on the vertical axis and Offender Scores (0β9+) on the horizontal axis. The intersection determines the presumptive sentence range in months.
- β’Burglary Classifications: Burglary 1 is the most serious (Level VII, Class A), followed by Residential Burglary (Level IV, Class B), and Burglary 2 (Level III, Class B). The distinction depends on the type of structure entered and the presence of weapons or assault.
- β’Not Violent Offenses: Unlike assault and robbery, burglary offenses are not classified as "violent offenses" under RCW 9.94A.030. However, they are serious felonies with significant prison time.
- β’Weapon Enhancements: If a firearm or deadly weapon is used during the burglary, mandatory enhancements apply under RCW 9.94A.533. These enhancements run consecutively (added on top of) the base sentence and cannot be reduced by good behavior credits.
- β’Enhancement Periods: Firearm enhancements are 60 months for Class A felonies (Burglary 1) and 36 months for Class B felonies (Residential Burglary, Burglary 2). Deadly weapon enhancements are 24 months for Class A and 18 months for Class B.
- β’Earned Release Time: Offenders may earn up to 1/3 reduction in their base sentence through good behavior and program participation under RCW 9.94A.729. However, enhancement time cannot be reduced.
- β’Maximum Fines: Class A felonies carry a maximum fine of $50,000. Class B felonies carry a maximum fine of $20,000. Courts may impose fines up to these statutory maximums in addition to imprisonment.
- β’Community Custody: After release from prison, defendants serve a period of community custody (similar to parole). The length depends on the offense and sentence, typically ranging from 9 to 36 months.
- β’Restitution: Courts will order restitution to compensate victims for losses caused by the burglary. This is separate from fines and can be substantial.
- β’Collateral Consequences: Burglary convictions result in loss of firearm rights, impact voting rights during incarceration, affect employment opportunities, and can have immigration consequences for non-citizens.
