Definitions & Important Information

Prior Offense Definition

For Washington DUI sentencing, "prior offenses" are counted within 7 years (before or after the current offense) and include:

  • DUI (RCW 46.61.502)
  • Physical Control (RCW 46.61.504)
  • Negligent Driving in the First Degree (if originally charged as DUI or Physical Control)
  • Commercial DUI convictions
  • Watercraft, Aircraft, Nonhighway Vehicle, or Snowmobile DUI
  • Certain deferred prosecutions and amended charges
  • Out-of-state convictions for substantially similar offenses

Electronic Home Monitoring (EHM)

EHM is an alternative or supplement to jail time:

  • No Prior Offenses: EHM can replace the minimum jail time in some cases
  • 1 Prior Offense: EHM is mandatory and may be used with alternative programs
  • 2 Prior Offenses: EHM is required PLUS minimum jail time must still be served

24/7 Sobriety Program

The 24/7 Sobriety Program is a monitoring program that may be available as an alternative to EHM or jail:
